Attorneys and Legal Counsel for JPAs

Having represented Joint Power Authorities (JPAs) since the mid-1990s, our attorneys understand the pertinent law, operations and characteristics of California JPAs and the unique interrelationship between a JPA and its members.  Our experienced attorneys assist JPAs in several distinct areas.

Many California JPAs exist to pool risk for their members, and may retain our lawyers to represent their member public entities.  In the event of an adverse judgment at trial, JPAs need experienced appellate counsel that understand the needs of the particular member, as well as the importance of precedent-setting decisions on other similar public entities. Our attorneys often represent public entities in high-profile appeals, including many resulting in published opinions.

Our lawyers also work with claims and risk management services companies to provide litigation management assistance and risk avoidance planning.

Risk pool JPAs normally have a coverage contract or memorandum of coverage describing the scope of the coverage provided.  When issues arise about the scope of that coverage, our attorneys are able to analyze the language of the relevant Coverage Contracts or Memoranda of Coverage, with an appreciation for the purpose and intent of public entity risk pooling.  While such documents may in some ways resemble insurance, there are important differences not appreciated by attorney firms without our experience. Our lawyers also represent risk pool JPAs when they have disputes with insurers who may provide reinsurance, concurrent coverage or consecutive coverage.
