Alan W. Foutz began his legal career as a public interest lawyer representing clients in cases where individual liberties or property rights were being threatened by government authorities.  During this time Mr. Foutz argued cases before California’s First and Third District Courts of Appeal and the California Supreme Court.  Mr. Foutz then spent five years as Chief Counsel of California’s Unemployment Insurance Appeals Board, advising the Board on the myriad legal, administrative, and employment matters that it dealt with on a daily basis.  He then spent several years with Murphy Campbell attorneys defending insured individuals and businesses in general liability and personal injury matters as well as insurance companies that had been accused of “bad faith” practices.

Before returning to Murphy Campbell, Mr. Foutz was in-house counsel for Zurich North America, focusing on defending several sub-contractor trades in construction defect litigation.  While at Zurich, Mr. Foutz was able to obtain favorable outcomes for his clients through effective use of pre-trial motions and by skilled negotiation in mediations.

Mr. Foutz is also an experienced mediator, having mediated numerous cases in the areas of personal injury, business, homeowner’s association, and employment disputes, as well as a broad range of construction-related cases.  Mr. Foutz received training in mediating litigated cases from the highly regarded Straus Institute for Dispute Resolution at Pepperdine University.  He has mediated cases that involve just a few thousand dollars up to cases with tens of millions at stake.

Mr. Foutz is admitted to practice in the State of California and before the U.S. District Courts for the Eastern and Northern Districts of California, the Ninth Circuit Court of Appeals and the United States Supreme Court.
